| 中文摘要(Abstrct) | 「法拍不動產交易制度」係指債權人為滿足其金錢債權，依強制執行法及相關法令規定，聲請地方法院民事執行處強制查封、拍賣債務人之不動產，由拍定人或承受人依法定程序買受後，債權人就該賣得價金而受清償之交易制度。法拍不動產因具按拍次減價拍賣之特性，相較於其他不動產交易價格為低廉，乃係吸引有意購置不動產者之主要誘因，致使法拍不動產之市場佔有率逐漸增加。然而，標購法拍不動產之程序，常令欲購置者望而怯步，實際上簡單的出價搶標過程，隱含諸多須待標購者處理之法律問題，更有遭受損害之可能。為瞭解標購法拍不動產可能產生之糾紛爭點，本研究首先整理闡述法院拍賣不動產之流程，再透過司法判決量化分析方式，以最高法院及高等法院有關法拍不動產糾紛案件之121件判決，探討法拍不動產交易糾紛判決之整體趨勢，進一步利用法律經濟學觀點探討爭點之重要法規範，以作為法拍不動產交易法制規範調整方向之參考。 |
| ABSTRCT | “The court auction real estate transaction institution” is in order to let the obligee can pay off the creditor's rights. The winner of the auction or expromissor purchases the real estate is according to the compulsory execution law, which applies for civil execution by the court to seal up and auction off the real estate. Due to the reduced price by the frequency of auction, the setting price in the court auction is relatively lower than those in other markets. Thus, it provides incentives for buyers to consume in auction market. As the result, the market share of the court auction real estate has been increasing gradually. However, the public often refuse to get involved of the market because of its highly controversial bidding procedure, which will potentially damage the gains from the transaction. This paper adopts an approach based on law and economics that incorporates the transaction costs to discuss the controversial issues of court auction in the real estate market. First of all, in order to realize the debate relating to the court auction real estate, the procedure in the auction market are introduced. Secondly, using the quantitative judgment analysis, this will be applied to 121 relevant cases from both Supreme Court and High Court. To reveal the judgment tendency. Finally, in accordance with the research findings to bring up suggestion enhance the safety and profit in the auction market. |
